1. PROMOTION DESCRIPTION: The Bucked Up Gold Giveaway begins on March 30, 2023, at 12:01 a.m. MST and ends on May 23, 2023, at 11:59 p.m. MST, or when all 50,000 gold bottles of Bucked Up Pre-Workout are sold out at GNC and other retail stores within the United States. The sponsor of this Giveaway is DAS LABS LLC. By participating in the Giveaway, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of entries and the overall administration of the Giveaway. Entrants should look solely to Sponsor with any questions, comments or problems related to the Giveaway. Sponsor may be reached by email at [email protected] during the Promotion Period.

2. ELIGIBILITY: Open to legal residents of the United States who are 18 years of age or older. Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees are ineligible to enter the Giveaway or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win;Household Members; shall mean those people who share the same residence at least three months a year. Immediate Family Members; shall mean parents, stepparents, legal guardians, children, stepchildren, siblings, stepsiblings, or spouses. This Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

3. PRIZES: 1,200 prizes will be awarded to 1,200 winners. Five (5) winners will receive a cruise getaway for (2) people, valued at approximately $1500, and $1,000 in cash to spend on airfare. 95 winners will receive $250 in cash. 300 winners will receive $100 in cash. 300 winners will receive $50 in cash. 300 winners will receive $200 in store credit on BuckedUp.com. 200 winners will receive $50 in store credit on BuckedUp.com. The approximate retail value or “ARV” of the cruise getaway, including the $1,000 in spending cash, is $2,500. The ARV of the prize represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of this prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Grand Prize is forfeited if cancelled by the winner within 60 days of the cruise date. Other restrictions, conditions, and limitations may apply. Restrictions, conditions, and limitations may apply. This promotion is open to legal residents of the United States, and prizes will only be awarded and/or delivered to addresses within the United States. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize.

4. HOW TO ENTER: Enter the Sweepstakes during the Promotion Period in one of the two ways below. Participants do not need to make a BUCKED UP purchase of any kind to be deemed an unofficial or official winner.

a. PURCHASE ENTRY: Purchase a gold bottle of Bucked Up Pre-Workout at any GNC store within the United States. If the gold bottle purchase contains a golden ticket, then go to www.buckedup.com/goldenticket and enter where indicated the ten-digit code shown on your ticket to redeem your prize associated with your ticket.

b. MAIL-IN ENTRY - NO PURCHASE NECESSARY: Mail a legibly handwritten, self-addressed, stamped envelope (“SASE”) with sufficient postage and a return address, including first and last name, street address, city, state, ZIP code and email address to: ATTN: Bucked Up Gold Giveaway, 815 West University Parkway, Orem, UT 84058. One entry will be made in the Giveaway for each mail-in request that complies with the requirements of the Official Rules. Limit one mail-in entry perperson. Mail-in requests, including both outer envelope and SASE, must be handwritten. Outer envelope must include a return address in the upper left-hand corner that matches the requestor’s street address and must be postmarked no sooner than the first day of Promotion Period and no later than the last day of the Promotion Period and received by Sponsor no later than one (1) week following the last day of the Promotion Period. Requests from Vermont (“VT”) residents that are postmarked in VT may omit return postage. Requests from VT residents that are postmarked outside of VT and omit return postage may be required to provide proof of VT residency to Sponsors reasonable satisfaction before requests are fulfilled. Each request must be mailed in a separate stamped outer mailing envelope. Requests that are sent in business reply envelopes, that utilize address labels or stickers (for any address), that are photocopied, hand-stamped, computer-generated or otherwise mechanically or digitally produced or reproduced, that are not mailed in separate outer stamped mailing envelopes, or that otherwise fail to comply with the Official Rules, will NOT be honored, acknowledged or returned, and the persons submitting such requests will forfeit any corresponding postage and unused envelopes. Any attempt by Entrant to obtain Entries by using multiple/different email or physical addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrants Entries, and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification. All Entries must be posted by the end of the Promotion Period to participate. Sponsors database clock will be the official timekeeper for this Giveaway.

5. WINNER SELECTION: The Winners of the Giveaway are determined by those who have golden tickets in the gold bottles of Bucked Up Pre-Workout that they have purchased and also will be selected in a random drawing using an online randomizer program from among all eligible Entries received throughout the Promotion Period to be conducted by May 23, 2023. Random drawings will be conducted by Sponsor or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible Entries received.

6. WINNER NOTIFICATION: Winners are notified by finding a golden ticket in a gold bottle of Bucked Up Pre-Workout that they have purchased and also will be notified by email message sent to the email address provided at the time of the mail-in entry in the giveaway approximately seven (7) days after the random drawing. Potential Winner(s) must accept a prize by email response as directed by Sponsor within seven (7) days of notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive telephone or email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any telephone or email account. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and waiver and release of liability, and a Publicity Release (collectively the Prize Claim Documents). No substitution or transfer of a prize is permitted except by Sponsor.

7. PRIVACY: Any personal information supplied by you will be subject to the privacy policy of the Sponsor. By entering the Giveaway, you grant Sponsor permission to share your personally identifiable information with the other Giveaway Entities for the purpose of administration and prize fulfillment, including use in a publicly available Winners list.

8. LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Giveaway; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Giveaway; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; (f) any injury or damage to participants or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Giveaway or download of any materials in the Giveaway. If, for any reason, the Giveaway is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway, in whole or in part. In such an event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Giveaway; or (g) any physical or psychological injury that Entrant may suffer because of Entrant’s participation in the Giveaway, including but not limited to Entrant’s participation in claiming the prize that is the subject of the Giveaway. Entrant acknowledges that Entrant is participating in the Giveaway at Entrant’s own risk and that Sponsor assumes no liability whatsoever for any harm or injury that may occur to Entrant as a result of Entrant’s participation in the Giveaway.

9. WINNER LIST/OFFICIAL RULES: To obtain a copy of the Winner(s) List or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to DAS Labs LLC, cc: Bucked Up Gold Giveaway, 815 W University Parkway, Orem, UT 84058. Requests for the names of the winners must be received no later than 30 days after the Promotion Period has ended.
